1. Agreement

These Terms & Conditions govern your access to and use of the Fitness OS website and platform. By creating an account or purchasing a subscription you agree to these Terms. If you are using Fitness OS on behalf of a business, you represent that you are authorised to bind that business.

2. Subscriptions & billing

Fitness OS is sold as a monthly subscription (Pro, Partner, or Platinum). Each plan begins with a 14-day free trial; you are not charged until the trial ends, and your subscription then renews automatically each month until cancelled. Prices are in USD unless stated otherwise and exclude applicable taxes.

You may upgrade, downgrade, or cancel at any time from your account or by contacting support. Cancellation takes effect at the end of the current billing period. Refunds are handled under our Refund Policy.

3. Your content & data

You retain all rights to the data you and your members upload to the platform. You grant us a limited licence to host and process that data solely to provide the service. You are responsible for having the right to upload the data you use in the platform and for complying with applicable privacy and marketing laws (including SMS/email consent rules) in your communications.

4. Acceptable use

You agree to use the platform in accordance with our Acceptable Use Policy. We may suspend or terminate accounts that breach it.

5. White-label & reseller terms

Scale subscriptions include a white-label licence permitting you to rebrand and resell the platform to your own customers. You are responsible for your customer relationships, billing, and first-line support, and must not misrepresent your relationship with Fitness OS.

6. Availability & changes

We aim for high availability but do not guarantee the service will be uninterrupted or error-free. We may modify features from time to time, and will not materially reduce the core functionality of your plan during a paid term without notice.

7. Limitation of liability

To the maximum extent permitted by law, Fitness OS is not liable for indirect, incidental, or consequential loss, or loss of profits, revenue, or data. Our total liability for any claim is limited to the amount you paid us in the 3 months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law, including under the Australian Consumer Law.

8. Governing law

These Terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
